These General Terms and Conditions of Sale are concluded between

Any individual, legal entity, or customer wishing to make a purchase via the website mysticgraceyoga.com shall hereinafter be referred to as ‘the Buyer.
The entrepreneur is the owner of the domain mysticgraceyoga.com, a site for the sale of yoga services online.

Article 1 – Purpose

These General Terms and Conditions of Sale (GTC) define the contractual relationship between the entrepreneur and the buyer and the terms applicable to any purchase made via the online store mysticgraceyoga.com. Acquiring a service through this website implies unreserved acceptance by the buyer of these terms. These terms take precedence over any other general or specific terms not expressly agreed upon by the entrepreneur.

The entrepreneur reserves the right to modify the terms at any time. In such a case, the applicable terms will be those in effect at the date of the buyer’s order.

If the user does not accept the GTC, they must not use the services offered on the Site.
Entrepreneur reserves the right to modify or delete, in whole or in part, the Site without notice or prior information to users, and cannot be held responsible to them or any third party.

Article 2 – Disclaimer

The entrepreneur disclaims all liability for any damage or accident during video yoga sessions sold on mysticgraceyoga.com.

The client acknowledges being aware that the physical activities proposed by the entrepreneur require good physical condition. The client assumes full responsibility for all consequences and risks directly or indirectly related to the practice of yoga.

The client agrees that neither they, their relatives, nor a legal representative will bring legal action against the entrepreneur or make any claim for any physical injury, theft, or damage to personal belongings.

It is essential to follow the teacher’s instructions attentively and carefully to avoid risks. The entrepreneur does not guarantee medical or athletic results. Results may vary depending on the individual’s physical differences and the frequency of practice. In case of health problems or doubt, it is important to consult a doctor to identify any movements to avoid, as yoga cannot replace medical advice or treatment. Some exercises may not be recommended, depending on the practitioner’s physical condition.

It is crucial for women participating in pregnancy yoga to notify their instructor about the progress of their pregnancy, any medical conditions, and any symptoms they may be experiencing. Before enrolling in the class, participants must complete an online form and schedule a complimentary 30-minute one-on-one session with the instructor to discuss their medical history and symptoms. The information shared with the instructor will remain confidential and will be used solely to provide the best possible guidance, without replacing medical advice. Additionally, a written attestation from a doctor is required to participate in pregnancy yoga, particularly in cases of high-risk pregnancies. Mystic Grace Yoga is committed to maintaining the highest standards of quality and safety in its classes. To ensure the well-being of all participants, instructors must be informed in writing about any medical conditions. No exceptions will be made.

Article 3 – Registration

To register, the buyer must provide the following information when creating their account:

  • Name
  • E-mail
  • Date of birth
  • Gender
  • country
  • phone number

These details are essential for processing the buyer’s order by the entrepreneur. The buyer agrees that this information is accurate, sincere, complete, and always up to date, enabling the entrepreneur to process their order.

The buyer acknowledges that all costs associated with accessing the Site, including equipment, software, and internet access fees, are solely their responsibility. They remain responsible for their computer equipment’s functionality and internet access.

To register on the Site and access a course, the buyer must:

  1. Provide the requested details (name, email, date of the service).
  2. Make the payment under the prescribed conditions.
  3. Confirm their order and payment.

Order confirmation implies acceptance of these terms and conditions, acknowledgment of their knowledge, and renunciation of their terms of purchase or other terms. All provided data and the recorded confirmation serve as proof of the transaction. The confirmation will equate to a signature and acceptance of the transactions carried out. The seller will send order confirmation via email.

Article 4 – Payment

Payment is processed via the online service PayPal. Prices shown on the website are excluding tax (HT – Hors Taxe).

Once the payment is validated, the buyer’s order is recorded. For invoices, please contact mysticgraceyoga@gmail.com.

Article 5 – Delivery Terms

Yoga classes are conducted online via the Zoom meeting application on the dates and times agreed upon during the reservation on mysticgraceyoga.com. The buyer commits to being present at the scheduled time and adhering to the operational rules of Mystic Grace Yoga. If you fail to attend the class without providing prior notice, the class will be considered as completed, and no refund or supplementary class will be offered.

Article 6 – Refund Policy

Once a class or package has been purchased and payment has been received, no refunds shall be issued under any circumstances. A fixed schedule and usage period for the classes is provided online at the time of purchase. It is the responsibility of the Buyer to attend and complete the classes within the specified timeframe. Failure to do so will not entitle the Buyer to any refund, credit, or rescheduling.

The policies are as follows:

  1. All purchases are final and non-refundable.
  2. Classes must be used within the designated period stated at the time of purchase.
  3. Unused classes after the expiration date will be forfeited.
  4. Extensions or exceptions will not be granted unless required by law.

Cancellation by the Entrepreneur

If the Entrepreneur cancels a class less than forty-eight (48) hours before its scheduled start time, the Buyer shall be entitled to a full refund of the class fee or compensated with another class. If the cancellation occurs more than forty-eight (48) hours in advance, the class shall be rescheduled to a later date, as agreed upon by both parties. No additional compensation shall be provided beyond the refund or rescheduling, as applicable.

In exceptional circumstances, and solely at the discretion of the Entrepreneur, purchased services may be extended, rescheduled, or refunded, provided that such changes are agreed upon in writing in advance. These accommodations are not guaranteed and shall not be construed as an entitlement. Any modification will only be granted upon mutual agreement following direct communication with the Entrepreneur.

Article 7 – Intellectual Property

All content available on the website, including but not limited to photographs, logos, images, audio, video, illustrations, the site’s structure, and underlying databases, is protected by applicable intellectual property laws and remains the exclusive property of the Entrepreneur.

Nothing in these General Terms and Conditions (GTC) shall be construed as transferring any intellectual property rights to the Buyer or any third party. Access to and use of the website is granted solely for personal, non-commercial purposes.

Any reproduction, representation, distribution, transmission, modification, or exploitation of the website’s content, in whole or in part, without the prior written consent of the Entrepreneur, is strictly prohibited.

The Entrepreneur grants Buyers a non-transferable, non-exclusive, and revocable license to use the purchased services strictly following their intended purpose. This license does not include any rights to copy, modify, distribute, or otherwise commercially exploit the content. Any reproduction or imitation of the website’s content or services, in any form and by any means, is expressly forbidden.

Article 8 – Warranty Exclusion

The buyer acknowledges that:
  • The entrepreneur does not guarantee the absence of viruses or technical anomalies on mysticgraceyoga.com.
  • The entrepreneur is not liable for network interruptions, slowdowns, or inaccessibility caused by internet congestion.
  • The Entrepreneur reserves the right to modify, suspend, or discontinue access to the Website or any part of its services at any time, without prior notice and liability. If such action affects services already paid for and not yet rendered, eligible Buyers will be refunded the corresponding amount paid for the unfulfilled portion of the service.

Article 9 – Availability

The entrepreneur strives to maintain Site availability but is not obligated to do so. Interruptions may occur due to maintenance or other reasons without prior notification, and no indemnity will be granted.

Article 10 – Cookies

Cookies or similar technologies are used to ensure website performance, enhance security, and analyze visitor data.

Article 11 – Personal Data

Personal data collected through the Website is processed following applicable French data protection laws, including the Informatique et Libertés Act (Loi n°78-17 du 6 Janvier 1978) and, where applicable, the General Data Protection Regulation (GDPR) (EU) 2016/679.

Article 12 – Modification of the GTC

The applicable GTC are those available on mysticgraceyoga.com during the user’s visit. Updates will be notified to buyers.

Article 13 – Governing Law and Disputes

These General Terms and Conditions (GTC) are governed by and interpreted under French law. In the event of any dispute arising out of or relating to the interpretation, performance, or validity of these GTC, the parties shall first attempt to resolve the matter amicably.

If an amicable resolution cannot be reached, the dispute shall be submitted to the competent courts of France, which shall have exclusive jurisdiction.

Article 14- Class etiquette

The use of abusive, offensive, discriminatory, or inappropriate language is strictly prohibited. Anyone engaging in such behavior will be denied access to classes, with no refunds provided.

The Entrepreneur maintains a strict zero tolerance policy for any form of misbehavior, aggression, or disruptive conduct towards the teacher, other students, or any individuals present in the environment. Displays of aggression, power struggles, or any behavior that compromises the well-being of others are strictly prohibited. A peaceful and respectful environment is essential for fostering personal growth and well-being. All participants are expected to conduct themselves in a manner that promotes harmony, respect, and mutual consideration within the space.

  • Participants should wear suitable clothing for yoga practice..
  • Recording or sharing any part of the class, including the instructor’s teachings or other participants’ images, is prohibited unless explicitly permitted by Mystic Grace Yoga.
  • Respect the privacy of other participants by not sharing their personal information or comments without consent.
  • Please join the class on time to avoid disruptions.
  • Inform the instructor in advance if you need to leave the session early.
  • Ensure a stable internet connection and a quiet space for practice to minimize disruptions.
  • Test your audio and video settings before joining the class.
  • Keep your microphone muted unless instructed otherwise by the instructor.
  • Using the class platform to promote personal services, products, or events unrelated to Mystic Grace Yoga is not allowed.
  •   Mystic Grace Yoga reserves the right to remove participants from a session or deny access to future classes if these terms and conditions are violated.
  • Mystic Grace Yoga may update these terms and conditions at any time. Participants will be notified of any changes before they take effect.

Article 15- Rights of Image at Mystic Grace Yoga

At Mystic Grace Yoga, we respect the privacy of our clients. By participating in our classes, workshops, or events, you permit us to capture photos or videos for promotional purposes. If you prefer not to be photographed or recorded, please inform the instructor in writing beforehand.

Our classes will be recorded, and select clips may be shared on our social media platforms. We want to assure you that these videos will never feature embarrassing poses or positions, as the dignity of our clients is our top priority. Any photos taken during class will depict peaceful and respectful poses, such as Padmasana with hands folded in Namaste. We will never take or upload any embarrassing photos or videos to our social media handles.

We retain ownership of all images and videos, which may be used on our website, social media, and marketing materials. However, your privacy is important to us, and we will not share or sell your images to third parties without your consent.

If you wish to withdraw your consent at any time, please contact us, and we will remove any images or videos featuring you. No compensation is provided for the use of images.

For minors, parental consent is required for the use of their images.

By participating in our online yoga classes, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions. We appreciate your commitment to helping us maintain a positive, respectful, and harmonious community.
