GENERAL TERMS AND CONDITIONS OF SALE (GTC)

These General Terms and Conditions of Sale are concluded between:
Anupama SUMAN, hereinafter referred to as “the Entrepreneur”

Any individual or legal entity wishing to purchase or reserve a yoga service, hereinafter referred to as “the Buyer” or “the Participant”.
Mystic Grace Yoga offers in-person yoga classes and related services.
Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) define the contractual relationship between the Entrepreneur and the Buyer, as well as the conditions applicable to the purchase and reservation of yoga services.
Any reservation or participation in a class implies full and unconditional acceptance of these GTC.
The Entrepreneur reserves the right to modify these terms at any time. The applicable terms shall be those in force on the date of the reservation.
Article 2 – Nature of Services
The services provided consist of in-person yoga classes, workshops, or related wellness sessions conducted at a physical location specified at the time of booking.
The Entrepreneur reserves the right to modify the location, schedule, or format of classes when necessary.
Article 3 – Reservation Terms
To reserve a class, the Buyer must provide:
- Full name
- Email address
- Phone number
Additional information (including health-related details) may be requested when necessary to ensure participant safety.
A reservation is considered confirmed once:
- The requested information has been provided
- The booking has been accepted by the Entrepreneur
- Payment terms have been agreed upon
Confirmation (email, message, or verbal agreement) constitutes proof of the reservation.
The Buyer guarantees that all information provided is accurate and up to date.
Article 4 – Payment Terms
Payment is made on-site at the time of the class, unless otherwise agreed in advance.
Accepted payment methods may include:
- Cash
- Bank transfer
- Other mutually agreed methods
Prices are indicated excluding tax (HT – Hors Taxe) unless otherwise specified.
Article 5 – Attendance and Service Delivery
Classes take place in person, at the agreed date, time, and location.
Participants agree to:
- Arrive on time
- Respect the instructor’s guidance
- Maintain appropriate and respectful behavior
Classes are reserved in advance
If a Participant fails to attend a reserved class without prior notice, the Entrepreneur reserves the right to refuse future reservations or prioritize other clients.
Payment is made at the time of attendance, unless otherwise agreed.
Article 6 – Reservation and Cancellation Conditions
Classes are subject to prior reservation.
Participants are expected to inform the Entrepreneur as early as possible in case of cancellation or inability to attend.
In the event of repeated last-minute cancellations or absence without notice, the Entrepreneur reserves the right to:
- Refuse future reservations
- Prioritize other participants
The Entrepreneur reserves the right to cancel or reschedule a class if necessary. In such cases, Participants will be informed as soon as possible and offered an alternative session.
Article 7 – Health and Responsibility
Participation in yoga classes requires suitable physical condition.
The Participant acknowledges that:
- They are responsible for their own health and physical condition
- They participate at their own risk
The Participant must:
- Inform the instructor of any injury, medical condition, or pregnancy prior to the class
- Provide medical clearance where necessary (especially for pregnancy or specific conditions)
Yoga practice does not replace medical advice or treatment. Participants are encouraged to consult a healthcare professional if needed.
The Entrepreneur shall not be held liable for injuries, accidents, or health issues arising from participation, except in cases of proven fault.
Article 8 – Liability Disclaimer
The Entrepreneur shall not be held liable for:
- Any injury resulting from improper practice or failure to follow instructions
- Loss, theft, or damage to personal belongings
- External circumstances affecting attendance (e.g., transportation issues)
Participants are responsible for their personal belongings at all times.
Article 9 – Intellectual Property
All content associated with Mystic Grace Yoga (including teaching methods, materials, visuals, and branding) remains the exclusive property of the Entrepreneur.
Any reproduction, distribution, or use without prior written consent is strictly prohibited.
Article 10 – Personal Data
Personal data collected is used solely for:
- Managing reservations
- Communicating with participants
- Ensuring safety during classes
Data is processed in accordance with applicable French laws and the General Data Protection Regulation (GDPR).
Participants have the right to access, modify, or delete their data upon request.
Article 11 – Availability and Modifications (Adjusted)
The Entrepreneur reserves the right to:
- Modify class schedules or locations
- Cancel or reschedule a class when necessary
In the event of cancellation, Participants will be informed as soon as possible and offered an alternative session.
Article 12 – Code of Conduct (Class Etiquette)
Participants agree to:
- Always maintain respectful and appropriate behavior
- Refrain from abusive, offensive, or disruptive conduct
- Wear suitable clothing for yoga practice
- Bring necessary equipment (e.g., mat, water) if required
- Respect the privacy of other participants
The following are strictly prohibited:
- Recording or sharing class content without permission
- Promoting unrelated services or products during sessions
The Entrepreneur reserves the right to deny access or remove any participant who violates these rules, without refund.
Article 13 – Image Rights
By participating in classes, Participants consent to the possibility of photos or videos being taken for promotional purposes.
- No inappropriate or compromising images will be used
- Participants may object in writing prior to the class
- Consent may be withdrawn at any time
Images will not be sold or shared with third parties without consent.
Parental authorization is required for minors.
Article 14- Governing Law and Disputes
These GTC are governed by French law.
In the event of a dispute:
- The parties agree to seek an amicable resolution first
- Failing agreement, jurisdiction is assigned to the competent courts of France
Acknowledgment and Acceptance
By reserving or attending a class, the Participant acknowledges having read, understood, and accepted these General Terms and Conditions of Sale.
